Licensing Act 2003 - Regulations

Following public consultation in 2004, the Secretary of State laid regulations in Parliament on 13 January 2005 relating to transitional provisions, personal licences, hearings, premises licences and club premises certificates and the licensing authority register. These regulations provide details of how the new licensing regime operates, including the format of application forms, the requirements for plans of premises and details of operating schedules.

The regulations relating to fees were laid before Parliament on 20 January 2005. These regulations came into force on 7 February 2005, when Licensing Authorities began processing applications.

Following public consultation in 2005, the Secretary of State laid regulations in Parliament on 20 October 2005, relating to temporary event notices. These include details about the information needed for, and the process involved in, giving temporary event notices as well as the issuing of counter notices by licensing authorities.

The Licensing Act 2003 (Permitted Temporary Activities) (Notices) Regulations 2005
This includes:

  • Schedule 1 - Temporary Event Notice
  • Schedule 2 - Counter Notice - Permitted Temporary Activities

The Licensing Act 2003 (Transitional provisions) Order 2005.  This includes:

  • Schedule 1 - Application for an existing licence to be converted to a Premises application to vary a premises licence simultaneously
  • Schedule 2 - Form of consent given by the person whom the applicant wishes to be the Premises Supervisor
  • Schedule 3 - Form of consent given by the person who holds the existing licence
  • Schedule 4 - Application to convert and to vary a club premises certificate

The Licensing Act 2003 (Personal licences) Regulations 2005.  This includes:

  • Schedule 1 - Application for a Personal Licence
  • Schedule 2 - Application to renew a Personal Licence
  • Schedule 3 - Disclosure of convictions and declaration
  • Schedule 4 - Application for a Personal licence made by the holder of a justices' licence during the transitional period
