Confirmed Non-Immediate Article 4(1) Directions for Office and Light Industrial to Residential Developments

The Council made three non-immediate Article 4(1) Directions on 5 August 2016 to remove permitted development rights for changes of use from office and light industrial to residential.

This means that development in the descriptions set out in the First and Second Schedules below should not be carried out on the land described in the First and Second Schedules, unless planning permission is granted on an application made under Part III of the Town and Country Planning Act 1990 (As Amended).

FIRST SCHEDULE

Development consisting of a change of use of a building and any land within its curtilage from a use falling within Class B1(a) (offices) of the Schedule to the Use Classes Order, to a use falling within Class C3 (dwellinghouses) of that Schedule, being development comprised within Class O of Part 3 of Schedule 2 of the Order. This applies to properties and land at the following employment areas:

  • Croxley Green Business Park, Watford
  • Tolpits Lane Employment Area and
  • Maple Cross/Maple Lodge Employment Area

SECOND SCHEDULE

Development consisting of a change of use of a building and any land within its curtilage from a use falling within Class B1(c) (light industrial) of the Schedule to the Use Classes Order to a use falling within Class C3 (dwellinghouses) of that Schedule, being development comprised within Class PA of Part 3 of Schedule 2 of the Order. This applies to properties and land at the following employment area:

  • Tolpits Lane Employment Area

The Council consulted on the non-immediate Article 4(1) Directions between 5 August and 2 September 2016 and were subsequently confirmed by the Council on 13 October 2016. The Article 4(1) Directions outlined in the First Schedule will come into force on 5 August 2017 and the Article 4(1) Direction outlined in the Second Schedule will come into force on 30 September 2017.
