9. RECOMMENDATIONS OF THE EXECUTIVE COMMITTEE

To consider the recommendation of the Executive Committee held on 15 November 2004 contained within Minute EX102/04 (below), the recommendations of the Executive Committee held on 13 December 2004 contained within Minute EX122/04 and the recommendations from the Executive Committee meeting on 10 January 2005 contained within Minute EX146/04.

EX102/04 REVIEW OF CALL IN PROCEDURE - REPORT FROM THE COUNCIL CONSTITUTION WORKING PARTY

RECOMMENDED:-

(1) that section B (i) of Article 6 of the Constitution, relating to Policy Panels, be amended to show that a key function of the Panels is to review and/or scrutinise policies made or proposed to be made by the Council or other committees, and all Members be reminded of this function;

(2) that the following be approved as the accepted reasons for calling in a decision of the Executive Committee:-

·Decision is outside policy and budget framework (stating which policy or which part of the budget is being referred to; OR:-

· There had not been proper advance scrutiny at a Policy Panel or Working Party meeting prior to the Executive Committee taking the decision; OR

· The decision should rightly be considered a key decision and the decision was not contained in the Forward Plan and the exemptions for urgent key decisions have not been implemented or do not apply

(3) that the procedures for conducting call in as set out in paragraphs 7.2 to 7.20 of the report be agreed;

(4) that consequential amendments to the Constitution further to (2) and (3) above be agreed.

12. APPOINTMENTS TO OTHER COUNCIL BODIES

Notification has been received that County Councillor Eleanor Clarke has resigned as this Council's representative as a Governor to St Mary's JMI, Stockers Farm Road, Rickmansworth.

Contact has been made with the Chairman of the Governors, Mr Bailey, to check if their Governing Body had been re-constituted and whether they still wanted a District Council representative. He confirmed that the School had opted to appoint a parent governor rather than a District Council minority representative in future.

Members are asked to note that the appointment of a District Councillor to the governing body of St Mary's JMI School, Rickmansworth, is no longer required.
