Developer loses appeal

A property developer has lost their appeal against a Magistrates Court conviction for causing damage to protected tree.
Shandler Homes who were prosecuted by Three Rivers District Council in January 2012, appealed against the decision of St Albans Magistrates Court to convict the company of damaging a protected Silver Birch tree at a site in The Drive, Rickmansworth.
The appeal was dismissed at a hearing on 10 July at St Albans Crown Court. Three Rivers District Council were awarded £6,000 costs. This is in addition to the £10,000 costs and £1,000 fine awarded in January.
Councillor Keith Williams, Portfolio Holder for Leisure and Community, said:
“The developer has shown a complete disregard for tree protection law.”
“This case should send out a clear warning to others that damaging, pruning, or felling protected trees without permission has serious consequences, and that the Council will not hesitate to take action against them to protect our most valuable trees.”
